Real-World Testing

Article 60 provides an alternative route to real-world testing for providers who are not participating in a formal sandbox. It allows high-risk AI systems to be tested in real-world conditions, subject to a submitted testing plan and safeguards for participants.

Regulation (EU) 2024/1689 — Article 60(4)

Providers or prospective providers shall notify the market surveillance authority in the Member State where the testing in real-world conditions is to be conducted of their intention to conduct such testing at least 30 days before the start of the testing.

  • Real-world testing requires a formal testing plan submitted to the NCA at least 30 days in advance
  • Participants must give informed consent and may withdraw at any time without disadvantage
  • Personal data collected during testing must be deleted unless retention is necessary under other law
  • Providers must stop testing immediately if harm to participants is identified
  • Testing results must be documented and may inform the Article 11 technical documentation
