National Competent Authorities

Article 70 requires each Member State to designate one or more national competent authorities (NCAs) responsible for supervising the application and implementation of the AI Act. NCAs perform market surveillance under Regulation 2019/1020 and may designate a notified body for conformity assessment.

  • Each Member State must notify the Commission of its designated NCA(s) by 2 August 2025
  • NCAs have powers to request access to documentation, conduct on-site inspections, and order corrective measures
  • NCAs may impose fines under Article 99 or initiate proceedings before national courts
  • Cross-border coordination is managed through the AI Board to prevent regulatory fragmentation
  • Data protection authorities (DPAs) may be designated as NCAs for AI systems processing personal data
