Codes of Conduct

Article 95 encourages providers of non-high-risk AI systems to voluntarily adopt codes of conduct to apply one or more requirements from the regulation beyond their legal obligation. This creates a pathway for trustworthy AI signalling even for minimal-risk systems.

  • Codes of conduct are voluntary -- no legal obligation to adopt them for non-high-risk systems
  • Providers may include transparency, data governance, and human oversight measures voluntarily
  • The AI Office and Member States encourage development of sector-specific codes of conduct
  • Adherence to a voluntary code of conduct may support a commercial trust signal to customers
  • Voluntary codes do not create a presumption of conformity for high-risk systems -- only approved codes under Article 56 do
